This website and online store are operated by InstantVap Australia, a business operated by Bee Brothers Australia, ABN 68 670 173 832.
In these terms, “we”, “us” and “our” refer to Bee Brothers Australia trading as InstantVap Australia.
These Terms of Service, together with our Privacy Policy, Return and Refund Policy and Shipping Policy, govern your use of this website and purchases from our store.
Nothing in these terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded, including rights under the Australian Consumer Law.
2. Using our website
You must have the legal capacity to enter into a contract to place an order.
You agree to provide accurate and current account, billing, payment and delivery information. You are responsible for protecting your account credentials and for activity conducted through your account.
You must not misuse this website, interfere with its security, introduce malicious software, collect other customers’ information or use the website for an unlawful purpose.
3. Product information and availability
We take reasonable care to ensure product descriptions, specifications, photographs, compatibility information and prices are accurate. Colours and appearance may vary slightly depending on your screen and device.
Products and specifications may change or be discontinued. Availability is not guaranteed until we accept your order.
Product descriptions and website content provide general information only. Always follow the manufacturer’s instructions and applicable safety requirements.
4. Safe and lawful product use
InstantVap vaporisers must be used only in accordance with the manufacturer’s instructions and applicable Australian laws and regulations.
You are responsible for using compatible batteries and accessories, appropriate personal protective equipment, adequate ventilation and any chemical treatment only as permitted by its approved directions, label and applicable regulatory requirements.
Information on this website is not a substitute for manufacturer instructions, chemical labels, veterinary advice, biosecurity directions or guidance from the relevant regulator.
Nothing in this section limits our responsibility to supply products that are safe, of acceptable quality and fit for any purpose made known to us.
5. Orders
Placing an order is an offer to purchase. An order is accepted when we confirm it and receive payment.
We may decline or cancel an order because of product unavailability, an incorrect price or description, suspected fraud, delivery restrictions or another reasonable commercial or legal reason. If we cancel an order after payment, we will provide a full refund.
Contact us promptly if you need to change or cancel an order. We will try to help, but we may be unable to change an order after it has been processed or dispatched.
Products must not be purchased for unauthorised resale or export without our prior agreement.
6. Prices and payment
Prices are displayed in Australian dollars and include applicable taxes unless clearly stated otherwise. Delivery charges and any other applicable charges will be shown before you complete payment.
Promotional offers may have additional terms. If promotional terms conflict with these terms, the promotional terms apply to that promotion.
You confirm that you are authorised to use the payment method supplied with your order.
7. Shipping and delivery
Shipping destinations, charges and estimated delivery timeframes are described in our Shipping Policy and at checkout.
Delivery timeframes are estimates. We will take reasonable steps to dispatch and deliver orders within the stated timeframe and will contact you if a significant delay becomes known.
We remain responsible for the goods until they are delivered to the address supplied with your order, except where you arrange your own independent carrier. We are not responsible for delays or failed delivery caused by an incorrect or incomplete address supplied by you.
If an order is significantly delayed, lost or damaged in transit, contact us so we can investigate and provide an appropriate solution.
8. Returns, refunds and consumer guarantees
Returns and refunds are handled under our Return and Refund Policy.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Depending on the circumstances, you may be entitled to a repair, replacement, refund or compensation when a product is faulty, unsafe, not of acceptable quality, does not match its description or is not fit for a disclosed purpose.
The rights in our Return and Refund Policy are provided in addition to your statutory rights.
9. Intellectual property
Website content, including text, photographs, graphics, videos, designs, trademarks and logos, is owned by or licensed to us, the InstantVap manufacturer or the relevant rights holder.
You may view and use the website for personal or ordinary business purchasing purposes. You must not reproduce, republish, modify, distribute or commercially exploit website content without permission from the relevant rights holder.
10. Third-party services and Shopify
Our website may contain links to third-party websites or use services provided by third parties. Those services are governed by their own terms and privacy policies.
InstantVap Australia is powered by Shopify, which enables us to operate the online store. Sales made through this store are made directly between you and InstantVap Australia. Shopify is not the seller of the products purchased from us.
11. Privacy
Our collection, use and disclosure of personal information are described in our Privacy Policy. Shopify may also process information required to operate and improve the store, as explained in that policy.
12. Website availability and errors
We do not guarantee that the website will always be available or free from technical errors. We may correct genuine errors in product information, availability or pricing.
If an error affects an order you have placed, we will contact you and offer an appropriate correction, alternative or refund. Nothing in this section permits us to mislead customers or avoid an order that has already been validly accepted without a reasonable basis.
13. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect or consequential losses that were not reasonably foreseeable.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability arising under the Australian Consumer Law.
14. Suspension or termination
We may suspend or terminate access to the website where we reasonably believe a person has breached these terms, acted unlawfully, threatened the security of the store or harmed another person.
Termination does not affect rights and obligations that arose before termination.
15. Governing law
These terms are governed by the laws of New South Wales and the Commonwealth of Australia. The parties submit to the courts having jurisdiction in New South Wales, subject to any rights a customer has to bring a claim elsewhere under applicable law.
16. Changes to these terms
We may update these terms when our operations, services or legal obligations change. Updated terms will be published on this page with a revised date.
Changes do not retrospectively alter the terms applying to an order already accepted unless required by law or agreed with you.
